When replacement beats repair
Most of this site is about fixing what you have, because on Lake Guntersville that's usually the right money. New construction earns its place in three situations: the piling map came back mostly red, the structure was never properly permitted and can't be brought right as-is, or the dock you have simply isn't the dock your family uses — wrong slip size, no lift, no room to sit. In those cases a rebuild resets the clock on everything: structure, hardware, and TVA paperwork.
What the rules let you build
- Footprint: docks, slips, piers, and boathouses must fit within a 1,000 sq ft rectangular envelope at the end of the access walkway — 1,800 sq ft where the property qualifies as pre–November 1999 development. The walkway itself doesn't count against the footprint.
- Reach: no more than 150 feet from the shoreline, or one-third the distance to the opposite shore, whichever is less — this matters in Guntersville's narrower sloughs.
- Height: a second story is allowed as an open deck with railing; roofing or enclosing it is not, and non-compliant second stories are a known removal risk at resale.
- Approval first: construction starts after the Section 26a permit is issued, not before. Building ahead of approval risks modification or removal orders.
